The execution of judgments of the European Court of Human Rights (Human rights Files No. 19, 2nd edition) (31/03/2008)

An important provision of the European Convention on Human Rights is that in the event of a violation being found, not only is the state in question required to redress the consequences of the violation vis-?-vis the applicant ? by such means as reopening of proceedings at the origin of the violation, reversal of a judicial verdict, discontinuation of expulsion proceedings or, where necessary, payment of a monetary award to the applicant; but it must also take general measures to prevent the repetition of the violation. These latter measures may take the form, for example, of a change in legislation, recognition of the Court¡¯s judgment in national case-law, the appointment of extra judges or magistrates to absorb a backlog of cases, the construction of detention centres suitable for juvenile delinquents, the introduction of training for the police, or other similar steps. In this study, Elisabeth Lambert-Abdelgawad examines both individual measures and general measures taken by states in accordance with the Court¡¯s judgments and with the supervisory proceedings of the Committee of Ministers, as published in its human rights (DH) resolutions.

Gods in the city - Intercultural and inter-religious dialogue at local level (13/03/2008)

Clearly, "God is changing in Europe": religious faiths and beliefs are increasingly making their presence felt in the public arena, at all levels. Because religions are more and more often behind the forging and assertion of multiple identities, the authorities have a duty to take the utmost account of them when establishing democratic rules and arrangements for "living together". Local authorities are ideally placed to lead this work, which requires creativity, imagination, a willingness to engage in dialogue and the opening of meeting places. Such an approach needs to go hand-in-hand with an analysis of this new state of affairs. It also calls for the sharing of experience. It is for this reason that the Congress of Local and Regional Authorities of the Council of Europe has chosen this avenue and launched a debate, in which local political figures and university researchers have been closely involved. The fact that it is sizing up the issues thrown up by intercultural and interfaith dialogue and opting for an approach based on mutual knowledge means that it has chosen from the outset to break new ground. This is the key objective of this European contribution to democratic debate and to action by the authorities in the context of religious pluralism.

European Portfolio for Student Teachers of Languages - A reflection tool for language teacher education (20/03/2008)

The European Portfolio for Student Teachers of Languages (EPOSTL) is a document intended for students undergoing their initial teacher education which encourages them to reflect on the didactic knowledge and skills necessary to teach languages, helps them to assess their own didactic competences and enables them to monitor their progress and to record their experiences of teaching during the course of their teacher education. It was developed for the European Centre for Modern Languages of the Council of Europe by a team of teacher educators from Armenia, Austria, Norway, Poland and UK, assisted by student teachers and teacher educators from all 33 member states of the ECML. Building on insights from the Common European Framework of Reference and the European Language Portfolio as well as the European Commission-financed ! project European Profile for Language Teacher Education - A Frame of Reference (Profile), it seeks to help prepare students for their future profession in a variety of teaching contexts. Further, the EPOSTL can facilitate discussion of aims and curricula between teacher educators working within different national or European contexts.

Literacy and linguistic diversity in a global perspective - An intercultural exchange with African countries (13/03/2008)

This publication reflects the outcomes of a project which brought together experts and practitioners in the field of linguistic diversity and literacy from European and African countries with a view to opening a dialogue, to taking a comparative perspective and defining possible areas of mutually enriching co-operation and exchange. The question of promoting low-status and non-dominant languages in education is the core concern of contributions in this volume which also encompasses topics such as language awareness, stimulating and encouraging a reading culture in low-status languages and developing criteria for teaching and learning materials that respect linguistic diversity and promote multilingualism. Examples of good practice in valuing African languages include an awareness raising campaign in Cameroon, NGO act! ivities promoting literary production in Senegalese languages, the Stories Across Africa Project (StAAf) as well as initiatives of North-South cooperation in the fields of teacher training and materials development. This publication was conceptualised as a contribution to the African Union's Year of African Languages 2006/07.

Guidelines for Risk Assessment, Prevention and Management - Health risks and safety hazards related to pest organisms in stored products (14/03/2008)

A variety of human health problems result from infestation of stored food products due to inadequate protection. Among the health problems feature allergic reactions, illness resulting from introduced pathogens and adverse reactions to toxic substances. These problems derive from the contamination of the food with excretions, body parts, toxic metabolites from pest organisms and pesticide residues. This report reviews the biology, current control measures and consumer health risks associated with infestation of stored food products by insects, mites, birds, rodents and fungi. It also identifies a number of key actions required by all stakeholders to minimise these risks and thus ensure that stored food products are safe for human consumption.

In Europe the Roma form a community of some 8 million souls. They are a misunderstood people, isolated from the world by the negative stereotypes that surround them; for centuries, policies devised to deal with them have been aimed at their physical or cultural destruction. By raising awareness on why and how it manifests and exploring its impact on people and in society, gender-based violence will no longer go undetected. Gender really does matter, to women, to men, to young people - to all of us. This manual serves to explore these human rights issues and act upon them.

Cyberterrorism - The use of the Internet for terrorist purposes (14/01/2008)

Cyberterrorism and the misuse of Internet for terrorist purposes represents a serious threat, since many essential aspects of today¡¯s society are completely dependent upon the functioning of computer systems and the Internet. Further to the adoption by the Council of Europe of the Cybercrime Convention (2001) and the Convention on the Prevention of Terrorism (2005), its Committee of Experts on Terrorism (CODEXTER) has been studying this matter and surveying the situation in member states to evaluate whether existing legal instruments are sufficient to combat this emerging form of crime. This publication contains an expert report prepared by the Max Planck Institute, which evaluates the main problems that arise in the context of cyberterrorism and provides recommendations, together with reports on the situation in the member and observer states of the Council of Europe and the relevant Council of Europe conventions. 28
Framework Convention for the Protection of National Minorities- Collected Texts (4th edition) (10/01/2008)

The protection of national minorities is a core issue for the Council of Europe, and one of the major achievements in this field is the Framework Convention for the Protection of National Minorities. The entry into force of the Framework Convention on 1 February 1998 was indeed an event of universal stature, for it is the first ever legally binding multilateral instrument devoted to the protection of national minorities in general. Its importance is widely acknowledged, and the number of ratifications has grown rapidly. Simultaneously, an emphasis is being placed on the implementation and on the efficient functioning of the monitoring mechanism of the Framework Convention. This collection provides all those interested in the protection of national minorities a user-friendly compilation of the basic texts concerning the Framework Convention. In addition to the Framework Convention and its explanatory memorandum, the collection contains texts pertaining to the monitoring mechanism in general and the Advisory Committee in particular. It further provides the state of signatures and ratifications as well as declarations and reservations. Invertebrate animals make up the greater part of the world's biological diversity and are present in all habitats, where they perform essential ecological functions. Their survival is fundamental to the maintenance of life as we know it. Large numbers of invertebrate species are under severe threat of extinction in Europe, or are already extinct due to the extreme transformations that European habitats have suffered due to human activities. The European Strategy for the conservation of invertebrates, adopted by the Council of Europe (Bern Convention) in 2006, addresses the loss of invertebrate biodiversity and promotes their conservation and the services they provide in terrestrial and non-marine aquatic environments. The Strategy offers appropriate guidance to European governments, other decision-makers, land managers, scientists and ! teachers that have potential influence on invertebrate conservation. 13

State of human rights and democracy in Europe

Protecting human rights and promoting democracy are the Council of Europe's two main tasks. But to what extent do the 47 member states live up to their commitments in these two crucial areas? The Parliamentary Assembly of the Council of Europe tried to answer this questioning an unprecedented political debate during its April 2007 session. The Parliamentary Assembly, and hence the 47 member states of the Council of Europe, has spoken with one voice, condemning this flagrant violation of human rights and demanding the closure of the Guantánamo detention centre. Work-related musculoskeletal disorders (MSDs) have a huge impact on European working life, in human, medical and financial terms. Efforts are being made on many fronts to reduce this impact. This report evaluates the effectiveness of some of the workplace interventions aimed at reducing symptoms and improving return to work. This evaluation is based on a thorough review of the literature on the rehabilitation, reintegration and retention ('the 3Rs') of workers suffering from work-related MSDs. The second part of the report contains an overview of policy in Europe as a whole, and in selected Member States, concerning the 3Rs as outlined above. This enables the reader to learn about the situation in the states and points up strengths and weaknesses in individual countries' policies on getting MSD sufferers back to work. 25

Social security as a human right - The protection afforded by the European Convention on Human Rights

There is no mention in the European Convention on Human Rights of rights in the field of social security. Nevertheless, the Convention does protect certain of these rights which come into its area of application and this study sets out to explain how. It also examines recent developments in the relevant case-law of the European Court of Human Rights which, as well as affording procedural guarantees, has widened and strengthened the material protection of specific rights. In addition, examples are given of measures taken in the member states following judgments of the Court in cases concerning social security. This sort of judgment is becoming more common, giving the Convention an ever-expanding social aspect which has an important impact at national level. 10
Co-operation against terrorism between the Council of Europe and its member states, and the International Criminal Police Organization (ICPO-Interpol) - Recommendation Rec(2007)1 and explanatory memorandum (22/08/2007)

Co-operation between law-enforcement authorities is one of the keys to a successful fight against terrorism. Recommendation Rec(2007)1 of the Committee of Ministers to member states regarding co-operation against terrorism between the Council of Europe and its member states, and the International Criminal Police Organization (ICPO-lnterpol) aims therefore to strengthen co-operation against terrorism through enhanced use of ICPO-lnterpol means. Thus, it recommends that governments of member states use, in accordance with national law, the tools offered by Interpol against terrorism, namely the Global Police Communications System I-24/7, the relevant databases and the real-time, operational support for police services as set out in the appendix to this recommendation. The Council of Europe's Committee of Experts on Terrorism (CODEXTER) is entrusted with the task of following-up its implementation. 8
The Pan-European Ecological Network: taking stock

The pace of biodiversity decline is quickening worldwide. Habitat break-up, pollution, over-use of natural areas and the creation of artificial landscapes increase the rate of erosion, while reducing species' opportunity for migration, dispersion and exchange. How and by what means can this situation be put right? In 1995, when the European Ministers of the Environment met in Sofia, they launched the Pan-European Biological and Landscape Diversity Strategy, so as to strengthen environment and biodiversity conservation policies. The setting up of the Pan-European Ecological Network covering Eurasia was one of the key steps taken under the Strategy. Work has continued on this project, and it is now based on the numerous national, regional and transregional ecological networks being set up throughout Europe. In Kiev, in 2003, the Ministers and heads of delegation noted these positive developments, expressed firm support for the creation of the Pan-European Ecological Network and asked for its constituent parts to be identified and mapped on a pan-European scale. This book looks at the implementation of this Network in the 55 states concerned. It has been written by a team comprising, under the aegis of the Council of Europe, numerous government experts and specialists dealing with the issue of ecological networks. Social inclusion for young people: breaking down the barriers (25/06/2007)

Social exclusion, the polarisation of the types of chances life offers to different groups of young people, is increasing, it is spatially concentrated in some regions and neighbourhoods and is arguably linked to social class. Race and gender can also contribute to this phenomenon, as can other inequalities such as disability. Social inclusion is therefore one of the central goals of European policies towards young people, especially in relation to employment, lifelong learning and vocational guidance. This book presents key findings from a research seminar organised by the European Youth Partnership on the theme of "Social inclusion and Young People" The articles included give a picture of the forms of social exclusion affecting young people nowadays and provide evidence of the progress of strategies to promote social inclusion. As part of the framework partnership agreement on youth between the Council of Europe and the European Commission, the research seminar and this publication support efforts in the fields of youth policy, education and training to build a more inclusive society for all.

Parenting in contemporary Europe: a positive approach (20/06/2007)

This publication is an important element of the Council of Europe's recent work in the field of positive parenting leading up to the Committee of Ministers' Recommendation Rec(2006)19 on policy to support positive parenting. The authors review and analyse the major changes affecting parenting in Europe, arising from legal situations, research and practice. This work addresses the core issues related to positive parenting and non-violent upbringing, with particular emphasis on parents' entitlement to support from the state in carrying out their parental tasks. Five themes are focused upon: 1. the legal situation and the results of research: what it means to be a parent according to the United Nations Convention on the Rights of the Child, the Council of Europe and new scientific knowledge; 2. current thinking on the use of violence and corporal punishment against children; 3. responses to family policy, especially in terms of support programmes and services for parenting and families; 4. the particular problems and needs of parents and children in situations of social exclusion; and 5. the relationship between parenting and drug-related behaviour among children and teenagers. The book also includes the text of the Recommendation Rec(2006)19, "Keys for parents" and "Guidelines for professionals".

Treaty of Nice

The Treaty of Nice was signed on the 26 February 2001. The main focus of the Nice Treatywas the reform of the EU's internal operating mechanisms, in order to allow an enlarged Union of around 27 members to operate efficiently. During the longest summit ever in EU history, the Heads of State or Government of the 15 member States finally reached agreement on issues including on the size and composition of the Commission, the re0weighting of votes in the Council, qualified-majority voting, the distribution of seats in the European Parliament and enhanced co-operation.
